Acceptance of the Terms of Use
These Terms of Use are entered into by and between you and Judgi Games LLC ("Company," "we," or "us"). The following terms and conditions, together with any documents they expressly incorporate by reference, collectively ("Terms of Use"), govern your access to and use of the Judgi app (“Judgi,” “the app”), including any content, functionality, and/or services offered on or through judgigame.com and judgigames.com (singularly, a "Website," collectively the "Websites").
Please read these Terms of Use carefully before you start to use the app. This agreement is between you and us. By using Judgi, you acknowledge you have read, understand, accept and agree to be bound and abide by these Terms of Use and our Privacy Policy which is found here. If you do not want to agree to these Terms of Use and/or our Privacy Policy, you should not access or use Judgi.
Eligibility
Judgi is offered and available to users who are 18 years of age or older. By using Judgi, you represent and warrant that (a) you are of legal age to form a binding contract with us and meet all of the eligibility requirements contained herein, or (b) if you are under 18 years of age, your parent or guardian has permitted you to use the app; has read, understood, accepted, and agreed to be bound by these Terms of Use; and has agreed to be responsible for your activities in connection with Judgi. If you do not meet all of these requirements, you must not access or use Judgi.
Changes to the Terms of Use
The company can change these terms at any time, and changes take effect immediately. Your continued use of the app means you accept the new terms.
Limited License to Use this Service
By complying with this Agreement, Judgi grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use and access the Service, solely for your personal, non-commercial use.
Accessing Judgi
We reserve the right to withdraw or amend Judgi, and any service or material we provide, in our sole discretion without notice. We will not be liable if for any reason all or any part of Judgi is unavailable at any time or for any period.
Intellectual Property Rights
All right, title and interest in and to Judgi and our services and products are and shall remain the exclusive property of Judgi and its Affiliated Parties. Judgi and our products and services are protected by copyright, trademark, and other laws of the United States and other countries. Nothing in these Terms of Use gives you the right to use or reproduce any of our trademarks, logos, domain names and other distinctive brand features.
We reserve all rights not expressly granted herein.
User Generated Content
User generated content (“UGC”) is defined as any content, material, data and information that you create, upload to, or transmit through the Service such as social media posts with images from the app. Anything you create and share through the app can be used by Judgi without further notice or compensation to you. You are responsible for ensuring you have the right to post any content and for not posting anything inappropriate.
License
On condition of your acceptance of these Terms of Use, we grant you a non-exclusive, limited, non-transferrable, freely revocable license to use Judgi and their contents for your personal, non-commercial use.
Prohibited Uses
You may use Judgi only for lawful purposes and in accordance with these Terms of Use. Do not use Judgi for illegal activities, to harm others, or to spread false information.
Changes to Judgi
The content of Judgi is not necessarily complete or up-to-date. Any of the information on Judgi may be out of date at any given time, and we are under no obligation to update such information or to do so on any particular schedule or timeframe.
Your Information
All information we collect on Judgi is subject to our Privacy Policy. By using Judgi, you consent to all actions taken by us with respect to your information in compliance with the Privacy Policy.
Online Purchases and Other Terms and Conditions
All purchases through the app or other transactions for the sale of goods formed through Judgi, or resulting from visits to our Websites made by you, are governed by these Terms of Use.
By purchasing Judgi, you are purchasing the game during a specific year. Purchases do not guarantee access to future year versions of Judgi.
Geographic Restrictions
We administer, control and operate Judgi from our offices in the State of Colorado, United States of America. Judgi is accessible world-wide. However, some of its features or functions may not be available or appropriate for use outside of the United States and/or may not be available to all persons or in all geographic locations. We make no representation that Judgi is appropriate or authorized for use in all countries, states, provinces, counties, localities or any other jurisdictions. Your access and use of Judgi may not be legal in Your jurisdiction. If you choose to access, browse or use Judgi, you do so on your own initiative and at your own risk, and you are responsible for compliance with all applicable laws if, and to the full extent that, such laws and restrictions are applicable. Access to Judgi may not be legal by certain persons or in certain countries.
The Site provides information of a general nature only. You are responsible for determining whether it applies to Your specific situation. We specifically disclaim any liability concerning any action that any individual may take based on any information or guidance provided by Judgi.
Limitations of Liability and Disclaimer
Judgi is provided "as is" without any guarantees about its operation or content. We are not responsible for any damages resulting from your use of the app.
Indemnification
You agree to protect the company from any legal claims related to your use of the app.
Termination
You can stop using the service at any time. The company can suspend or terminate your access without notice for violating terms.
Release
By law, you agree to release us, our affiliates, employees, and any related parties from any responsibility or claims, including disputes between users, third-party services, unauthorized access to your data, or any other related issues. If you have a dispute with other users or third-party service providers, you release us from all claims or damages arising from such disputes. You also waive certain rights under California law (Civil Code § 1542), which normally protect against unknown claims at the time of agreement.

California users are entitled to consumer rights through the Division of Consumer Services, which can be contacted for assistance.
Notice for New Jersey Users
Some sections, such as Disclaimers, Warranties, and Liability Limitations, do not apply to New Jersey users.
Governing Laws
You agree the laws of the United States of America and the laws of the State of Colorado, without regard to any principles of conflicts of laws, will govern these Terms of Use, our Privacy Policy, your use of Judgi, and all matters relating to your access to, and/or use of, Judgi, including all disputes between you and us. You also agree that: (i) Judgi shall be deemed solely based in Colorado; (ii) Judgi shall be passive sites that do not give rise to personal jurisdiction over us, either specific or general, in any jurisdiction other than Colorado; (iii) prior to filing any suit, the parties agree to mediation in good faith of any dispute, (iv) any litigation arising between the parties will be litigated in Colorado; and (v) should Company prevail in any litigation against you, whether brought by you or us, Judgi is entitled to recover its attorney fees and costs; should this provision be deemed unenforceable, either prevailing party shall be entitled to reasonable attorney fees and costs.
Waiver and Severability
No waiver by the Company of any term or condition set out in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.
If any part of these Terms of Use is determined to be invalid or unenforceable under applicable law, including the warranty disclaimers and liability limitations stated elsewhere herein, then the invalid or unenforceable provision(s) will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of these Terms of Use shall continue in full effect.
Entire Agreement
The Terms of Use and our Privacy Policy constitute the sole and entire agreement between you and Judgi regarding Judgi and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, whether electronic, written or oral, regarding Judgi, our services and our products.
These Terms of Use shall be deemed to include all other notices, policies, disclaimers and other terms and conditions contained in or on Judgi, including Our Privacy Policy; provided, however, these Terms of Use shall prevail in the event of a conflict with any such other documents. Any rights not expressly granted in these Terms of Use are reserved to us.
A printed version of these Terms of Use and of any notice given in electronic form shall be admissible in any and all judicial or administrative proceedings based upon or relating to these Terms of Use to the same extent as other business documents and records originally generated and maintained in printed form.
